HOW DOES THE PROCESS WORK?

Like every case, every mediation is different. But there are some constants. Each person will have the opportunity to, without interruption, provide the mediator and other party with whatever information the person feels is pertinent to resolving the dispute. Mediation Briefs
are encouraged. Each side should provide a written account of their version of the facts, the contentions of each of the parties, and the efforts that have been made to resolve the dispute.

Despite any animosity that may exist between the parties, each party will show the other respect and let them speak without interruption. Everyone gets his or her turn. In order for the process to have a maximum beneficial effect, it is important for the other party to really listen to what the other person is saying and try to appreciate his or her position, even if you do not agree with it.

If you are worried about not being able to communicate, Mr. Marcus has ways of dealing with recalcitrant parties. One benefit of mediation is that it can be done in sessions. If the parties are truly entrenched and cannot communicate, the mediation can take place with Mr. Marcus communicating separately with each party to resolve the case. Whatever the problems, chances are a comfortable way exists for both parties to try to resolve it.
